As a result, the federal government has extended accessibility requirements to public sector websites and mobile apps to ensure that all employees and the public have equal access.\n\nPublic sector organizations \u2013 including state and local governments, libraries, schools, and any organization that receives federal funding \u2013 face significant penalties if they are found to have violated accessibility requirements; physical or digital.\n\nCreating an accessible and inclusive website in the first place is the best strategy for avoiding complaints, investigations, and potential civil rights violations. Recite Me is a key accessibility partner for public sector organizations across the nation.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-6255233 disable-default elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"6255233\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-06e5749\" data-id=\"06e5749\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-48467e5 elementor-widget elementor-widget-text-editor\" data-id=\"48467e5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>Federal Laws and Enforcing Agencies<\/h2><div><p>The authority to require public sector organizations to provide accessible websites is derived from three key pieces of legislation, including:<\/p><ol><li><strong>Title II of the Americans with Disabilities Act (ADA)<\/strong> \u201cprohibits discrimination against qualified individuals with disabilities by public entities, including public education systems and institutions, regardless of whether they receive Federal financial assistance from the Department.\u201d<\/li><li><strong>Section 504 of the Rehabilitation Act of 1973 (Section 504)<\/strong> \u201cprohibits discrimination on the basis of disability in any program or activity receiving Federal financial assistance.\u201d<\/li><li><strong>Section 508 of the Amended Rehabilitation Act of 1998 (Section 508)<\/strong> applies primarily to federal agencies (but other public entities have adopted the requirements into their own laws) ensuring they \u201cgive disabled employees and members of the public access to information comparable to the access available to others.\u201d<\/li><\/ol><div>\u00a0<\/div><p>All 15 U.S. federal executive departments have the authority to investigate and pursue penalties for accessibility violations. However, the <strong>Departments of Justice (DOJ)<\/strong> and <strong>Education (ED)<\/strong> are the two most active. Investigations, finding determinations, and oversight of remediation efforts are conducted by the various departments\u2019 <strong>Offices of Civil Rights (OCR)<\/strong>.<\/p><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-8683ed9 disable-default elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"8683ed9\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-86fb99d\" data-id=\"86fb99d\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-aa2a175 elementor-widget elementor-widget-text-editor\" data-id=\"aa2a175\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>Accessibility Guidelines<\/h2><div><p>Currently, the DOJ does not have a written standard to determine compliance but uses the Web Content Accessibility Guidelines (WCAG) as guidelines to determine the accessibility of websites. In July of 2023, the <a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/08\/04\/2023-15823\/nondiscrimination-on-the-basis-of-disability-accessibility-of-web-information-and-services-of-state\">DOJ proposed a rule<\/a> under Title II of the ADA to formally establish and \u201crequire that public entities comply with the <a href=\"https:\/\/www.w3.org\/WAI\/standards-guidelines\/wcag\/new-in-21\/\">WCAG 2.1 Level AA<\/a> success criteria and conformance requirements.\u201d<\/p><p>Both departments have stepped up investigations and pursuit of accessibility violations over the last several years. On May 19, 2023, the Departments of Justice and Education issued a joint <a href=\"https:\/\/www.justice.gov\/crt\/case\/dear-colleague-letter-online-accessibility-postsecondary-institutions\">Dear Colleague Letter<\/a> reaffirming that educational institutions \u2013 from K-12 to postsecondary \u2013 must \u201censure that their online services, programs, and activities are accessible to people with disabilities.\u201d<\/p><p>Typical website accessibility violations that may lead to an investigation and violation finding include:<\/p><ul><li>Links were not meaningfully labeled or titled, posing a barrier to people with vision disabilities who use screen readers.<\/li><li>Users with disabilities who use computer keyboards for navigation due to a disability did not have access to all contents and functions.<\/li><li>Form fields were missing programmatic labels or titles, posing a barrier to people with vision disabilities who use screen readers.<\/li><li>Important graphics, images, or links were missing meaningful alternative text, posing a barrier to people with vision disabilities who use screen readers.<\/li><li>Documents provided in portable document format (pdf) were inaccessible to people with vision disabilities who use screen readers.<\/li><li>The foreground and background colors of important content lacked sufficient contrast, posing a barrier to people with low vision.<\/li><li>Auto-play content could not be paused, posing a barrier for individuals who are unable to use a computer mouse.<\/li><\/ul><div>\u00a0<\/div><\/div><p>In addition to the reputational stain of receiving a civil rights violation finding, public sector organizations face financial impacts, including:<\/p><ul><li>Federal fines<\/li><li>Attorney fees<\/li><li>Potential loss of federal funding<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-706848f disable-default elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"706848f\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-d216060\" data-id=\"d216060\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-60fbdd8 elementor-widget elementor-widget-text-editor\" data-id=\"60fbdd8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>The Investigative Process<\/h2><div><ol><li>The departments have a standardized<a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/complaints-how.html\"> process<\/a> to evaluate, investigate, and resolve violations. The process is initiated by the filing of a complaint by a private citizen or group with a federal department.\u00a0<\/li><li>The department evaluates the complaint to determine whether it&#8217;s within their jurisdiction and whether it merits more investigation.<\/li><li>If the department determines it will open an investigation into the complaint, it will notify the organization and begin collecting and analyzing relevant evidence.<\/li><li>Upon completion of the investigation, the department will make a determination whether the organization is in violation or not. A Letter of Finding will be sent to the organization outlining the results.<\/li><\/ol><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-3a8e3cf disable-default elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"3a8e3cf\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-3e95e44\" data-id=\"3e95e44\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-b64b9d6 elementor-widget elementor-widget-text-editor\" data-id=\"b64b9d6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>Resolution of a Complaint<\/h2><p>An organization can choose to negotiate and enter into a <strong>voluntary resolution agreement<\/strong> to remedy the potential violations prior to the completion of the investigation &#8211; and thus avoid the public stigma of a civil rights violation ruling. If an organization is determined to be in violation of the <a href=\"https:\/\/reciteme.com\/us\/news\/ada-web-accessibility-law\/\">ADA<\/a> or <a href=\"https:\/\/reciteme.com\/us\/news\/section-504-compliance\/\">Section 504<\/a> or <a href=\"https:\/\/reciteme.com\/us\/news\/section-508-compliance\/\">508<\/a>, it can still negotiate a voluntary resolution agreement after the fact.<\/p><p>A voluntary resolution agreement will include <em>steps to remediate the identified violations and maintain compliance with an established timeline<\/em>. The OCR will monitor the activities until the organization is determined to be in compliance. Entering into a resolution agreement \u201cdoes not constitute an admission of liability, non-compliance, or wrongdoing by the\u201d targeted organization.\u00a0<\/p><p>An organization can <strong>appeal the determination<\/strong> but that is to the OCR that made the determination.<\/p><p>If the organization does not agree to correct the violations or to the terms of a resolution agreement, the \u201cOCR may <strong>withdraw federal funds<\/strong>, initiate <strong>administrative enforcement proceedings<\/strong> or refer the case to the <strong>Department of Justice for judicial proceedings<\/strong> to enforce compliance.\u201d<\/p><p>The OCR also offers <strong>mediation<\/strong> between the complainant, the targeted organization, and the OCR in an effort for the parties to voluntarily resolve the issue prior to or during an investigation.<\/p><p>The person or group that filed the complaint may have the option to <strong>file a civil suit<\/strong> in a federal court regardless of the OCR ruling, but typically only after administrative remedies have been exhausted.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-ce123cc disable-default elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"ce123cc\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>Typical Remediation Plan<\/h2><p>The resolution agreements include a fairly standard series of remediation activities for an organization to achieve and maintain compliance along with reporting provisions within defined timeframes and an appendix with specific testing requirements to address accessibility protocols and questions.<\/p><p>\u00a0These standard remediation steps include:<\/p><ol><li>Adopt an Accessibility Standard and submit it to OCR for review and approval within 30 days of signing the agreement.<\/li><li>Provide accessibility notice on the website providing a method for visitors to report access barriers to the organization and report to OCR for review and approval within 30 days of signing the agreement.<\/li><li>Conduct a complete audit to identify accessibility barriers and report to OCR for review and approval within 120 days of signing the agreement.<\/li><li>Remediate barriers and report to OCR for review and approval within six months of signing the agreement.<\/li><li>OCR testing and assessment of the organization\u2019s testing protocols and remediation steps, which will continue until the OCR determines the website, services, and\/or applications are in compliance.<\/li><li>Develop a plan to maintain accessibility and submit it to OCR for review and approval within one year of signing the agreement.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section
